OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a struck-by hazards.  a). Alta Enterprise, LLC dba Alta Mine Services, LLC on or about September 29, 2023, at the location of 6185 Drouillard Rd. Northwood, OH 43619: The employer did not ensure the "Manual Lifting Magnet" and "Beam Clamp" had adequate legible markings indicating rated load capacity and identification. Employees utilizing overhead cranes with these below-the-hook lifting devices to move structural steel without the benefit of legible rated load capacity and identification, were exposed to a struck by hazards.  b). Alta Enterprise, LLC dba Alta Mine Services, LLC on or about September 29, 2023, at the location of 6185 Drouillard Rd. Northwood, OH 43619: The employer did not ensure the  "Manual Lifting Magnet"  was operated within its rated load capacity.  Employees tasked with handling structural steel with this below-the-hook lifting device, exceeded its rated load capacity, exposing employees to struck by hazards.
