29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i).  (a) Facility at 20 Providence Pike in NORTH SMITHFIELD, RI:  On or about October 10, 2023, employees were exposed to a fall hazard of approximately six feet and two inches (6'2") at the loading dock inside the northeast corner of the building without a guardrail or other adequate fall protection.

29 CFR  1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user.   (a) Facility at 20 Providence Pike in NORTH SMITHFIELD, RI:  On or about October 10, 2023, the employer provided elastomeric respirators, such as the 3M 7500 series with the P100 filter, without providing medical evaluations and training to ensure the employees in the fabrication area could safely wear the respirators and protect themselves from hazards including, but not limited to, silica dust.

(a) Facility at 20 Providence Pike in NORTH SMITHFIELD, RI:  On or about October 10, 2023, the employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, to employees that work in the shop area that were allowed to wear respiratory protection such as N-95s and elastomeric respirators.
