29 CFR 1910.134(c)(1): A written respiratory protection program (RPP) that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented where respirators were necessary to protect the health of employees:  At 286 Great Barrington Rd. Housatonic, MA: On October 6, 2023, and at times prior, the employer did not implement a RPP for employees who are required to wear half-face elastomeric and filtering facepiece device respirators while sanding sheet rock, utilization of hazardous materials, and grinding concrete.  ABATEMENT NOTE:  A respirator program shall include the following elements:    -Procedures for selecting respirators  -Medical evaluations for employees required to use respirators  -Procedures for fit testing tight fitting respirators  -Procedures for proper use of respirators  -Procedures and schedules for cleaning, storing, inspecting, and maintaining respirators  -Training of employees about respiratory hazards in the workplace  -Training on proper use of respirators  -Procedures for regularly evaluating the effectiveness of the program  *Abatement notes are intended only to provide clarity regarding existing requirements under the law or agency policies. Abatement notes do not create (or diminish) legal obligations under the Occupational Safety and Health Act.

29 CFR 1910.134(h)(4): Respirators that failed an inspection or were otherwise found to be defective were not removed from service and discarded or repaired:  At 286 Great Barrington Rd. Housatonic, MA: On October 6, 2023, and at times prior, the employer did not ensure that defective half-face elastomeric respirators were removed from service.  A Safety Works 9200 half-face respirator was observed with cracks and holes in the elastomeric portion of the respirator and a damaged head strap.  This condition exposed the employee to respirable crystalline silica.

At 286 Great Barrington Rd. Housatonic, MA: On October 6, 2023, and at times prior, the employer did not ensure that employees where quantitatively or qualitatively fit-tested for respirators prior to usage for sheet rock sanding, grinding stone, or handling hazardous chemicals.
