Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. a) On or about 10/06/2023, employer did not ensure a Yale Lift Truck (SN:C801N03386A), with an unsecured pallet added to the forks that employees were standing on to load inventory including 50-pound bags of rocks salt at elevations of 12'8", had received written approval from the manufacturer for the modification that affected capacity and safe operation.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. a) On or about 10/06/2023, employer did not ensure that inspections being conducted were adequate in that a Yale Lift Truck( SN:C801N03386A) with a 3M Self-Retracting Lifeline (SN: 163488) attached and used as the fall protection system was not examined for defects in that the lanyard had a knot in it while attached to the Yale life truck.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: (a)(3)The proper use of the scaffold, and the proper handling of materials on the scaffold; (a)(4)The maximum intended load and the load-carrying capacities of the scaffolds used; and (a)(5)Any other pertinent requirements of this subpart. a) On or about 10/06/2023, the employer did not ensure that employees elevated 12'8" and using an unsecured pallet as scaffolding were adequately trained on elements (a3-a5) by a person qualified to recognized the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.
