29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment: a) NDC warehouse- On or about October 3, 2023 and times prior to, employees were exposed to respiratory hazards in that, the employer failed to ensure that workplace hazard assessment was provided to employees installing and finishing accessories on consumer specific Rugged Terrain Vehicles (RTV) to determine if hazards were present and to provide proper PPE such as, but not limited to, respiratory protection.

29 CFR 1910.176(b): Material stored in tiers was not stacked, blocked, interlocked or limited in height so that it was stable and secure against sliding and collapse: a) NDC warehouse- On or about October 3, 2023, and at times prior, employees were exposed to struck-by hazards in that, the employer failed to ensure that the shelving where materials were stored was anchored to prevent accidental tip over when the industrial truck manufacturing materials were not stored in a stable condition and the damaged racks were not secured against collapse.
