29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: On or about September 6, 2023, four employees were exposed to struck-by hazards while performing an unapproved mobile zone on a multilane highway, where the adjacent roadway did not have adequate traffic control devices in accordance with the traffic control plan, to provide protection for traffic and workers and where the employer failed to provide employees the job plan, resulting in an accident.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees it that they were exposed to vehicular struck-by hazards: On or about September 6, 2023, employees engaged in an unapproved mobile zone for edge line removal on a multilane highway, were exposed to struck by hazards. Among other methods, one feasible and acceptable means of abatement would be to follow the Ohio Manual on Uniform Traffic Control Devices (OMUTCD), the Traffic Control Plan, and ANSI A10.47 for Work Zone Safety for Roadway Construction and: 1. Ensure the digital speed limit sign (DSL) was illuminated when employees were working in an active temporary construction zone at night. 2. Ensure a law enforcement officer was present while employees were working in a temporary construction zone at night. 3. Ensure a worksite traffic supervisor was present while employees were working in a temporary construction zone at night. 4. Ensure a Transportation Management Plan was prepared and communicated to the project engineer. 5. Ensure positive protection was used in a work zone with operating speeds greater than 45 miles per hour.

29 CFR 1926.200(g)(2): The employer did not ensure that all traffic control signs or devices used for protection of construction workers conformed to Part VI of the Manual on Uniform Traffic Control Devices (MUTCD) Millennium Edition, December 2009: On or about September 6, 2023, employees were exposed to struck-by hazards on Interstate 480 Westbound in North Olmsted Township, where the employer did not have the following traffic control signs or devices in use to protect the crew that had one out of three lanes of traffic closed for edge line removal purposes on an active temporary construction zone: a) The employer did not ensure advanced warning signs used for traffic control were properly placed for a single lane closure on a multilane highway, per the MUTCD. b) The employer did not ensure traffic control devices used for traffic control were properly placed for a single lane closure on a multilane highway, per the MUTCD c) The employer did not ensure an arrow board used for traffic control was properly placed for a right lane closure on a multilane highway, per the MUTCD. d) The employer did not ensure an adequate buffer zone was installed for a single lane closure on a multilane highway, per the MUTCD, exposing employees to struck-by hazards.
