OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment free from hazards associated with combustible dust when using and/or working near an industrial vacuum system: (a) Building 55, CP3 West Pit: On or about September 22, 2023, and times prior, employees used a stationary industrial vacuum system to vacuum powdered TPA on the ground and equipment in the vertical pit. The Hi-Vac vacuum was located in a non-hazardous location; however, a hose sections was improperly connected and the improperly connected hose was not grounded and bonded causing an electrostatic discharge felt by employees. (b) Building 55, TPA Unload Area: On or about October 4, 2023, and times prior, employees used a stationary industrial vacuum system to vacuum out large amounts of powdered TPA that spilled out onto the floor under a railcar due to an issue during the download process. The Hi-Vac vacuum was located in a non-hazardous location; however, a hose section was improperly connected and the improperly connected hose section was not grounded and bonded causing electrostatic discharge felt by employees. (c) Building 55, TPS Barn and CP3 TPA Pit: On or about November 14, 2023, and times prior, the employer did not provide or require the use of flame-retardant and no-static generating clothing to employees when working areas where combustible dust could be present.

(b) Building 55, CP3 West Pit: On or about November 14, 2023, and times prior, a mechanical device was not available to retrieve an employee who was working in a vertical confined space pit approximately 11ft. 8in deep. A 50ft. nylon rope was attached to a body harness and to a railing system around the confined space opening, exposing the employee to asphyxiation and fire hazards.
