29 CFR 1926.602(a)(2)(i): Material handling equipment with rollover protective structures or adequate canopy protection was not provided with seat belts. a) Lot 5 NE of 20719 Wilson Road, across from Stagg Run development, Georgetown, DE 19947: On or about October 11, 2023, subcontractor's employees were provided a Gradall rough terrain forklift for use on an unimproved lot to lift materials to the roof area requiring the forklift to be moved several times on the lot without providing a seat belt for use exposing employees to ejection and struck by hazards.

29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks. a) Lot 5 NE of 20719 Wilson Road, across from Stagg Run development, Georgetown, DE 19947: On or about October 11, 2023, a Gradall rough terrain forklift was used in a framing operation hoisting materials to the roof area of a newly built single-family home without having a manufacturer recommended seat in place and all nameplates and markings were not maintained in a legible condition.
