29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): (a) EMR USA Holdings, Inc. dba Rhino Recycling Inc. located at 2942 E Tioga St. Philadelphia, PA: On or about October 12, 2023, the employer did not ensure that powered industrial truck operators operating powered trucks such as, but not limited to, HELI G Series Lithium Battery Counterbalanced forklift truck (Model CPD35, S/N 05035DG2159) successfully completed the training and evaluation to ensure operators have the knowledge and skills needed to operate the powered industrial trucks safely. Training shall consist of a combination of formal instruction, practical training, and evaluation of the operator's performance in the workplace.
