29 CFR  1910.1053(d)(3)(iii):Where the most recent exposure monitoring indicated that employee exposures were at or above the action level but at or below the PEL, the employer did not repeat such monitoring within six months of the most recent monitoring:  On October 26, 2023, two shop employees were exposed to respirable crystalline silica (RCS) related health hazards when exposure levels were above the eight-hour time-weighted average (8-hour TWA) action level (AL) of 25 ug per cubic meter of air and monitoring has not been repited every six month:  1) Employee #1 performed polishing at the fabrication area and was exposed to respirable crystalline silica 1.9 times the action level. The employee's 8-hour TWA exposure was 48.4 ug respirable crystalline silica per cubic meter of air. 2) Employee #2 performed loading and unloading of countertop parts at the CNC area and was exposed to respirable crystalline silica 1.8 times the action level. The employee's 8-hour TWA exposure was 45.3 ug respirable crystalline silica per cubic meter of air.

29 CFR  1910.1053(i)(1)(i):The employer did not make medical surveillance available at no cost to each employee, and at a reasonable time and place, for each employee who has been occupationally exposed to respirable crystalline silica at or above the action level for 30 or more days per year:  On October 26, 2023, two shop employees were exposed to respirable crystalline silica (RCS) related health hazards when exposure levels were above the eight-hour time-weighted average (8-hour TWA) action level (AL) of 25 ug per cubic meter of air and no medical surveillance has been provided to them:  1) Employee #1 performed polishing at the fabrication area and was exposed to respirable crystalline silica 1.9 times the action level. The employee's 8-hour TWA exposure was 48.4 ug respirable crystalline silica per cubic meter of air. 2) Employee #2 performed loading and unloading of countertop parts at the CNC area and was exposed to respirable crystalline silica 1.8 times the action level. The employee's 8-hour TWA exposure was 45.3 ug respirable crystalline silica per cubic meter of air.

29 CFR  1910.134(c)(2)(i):Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:  At the fabrication are, employee(s) performing barrel painting activities while voluntary using respirator are exposed to health hazards. The employer did not determine if the voluntary use of a respirator did not in itself create a hazard before the employee used the respirator in the workplace.
