29 CFR  1926.1053(b)(4):Ladders were used for purposes other than the purpose for which they were designed:  a) 4295 South Route 130, Edgewater Park, NJ - Employees working for the company were working from a Werner FS100 six foot fiberglass step ladder, in a closed position, leaning against a wall and not fully open and braced as designed, thus exposing the employee to a ladder collapse hazard. This condition was observed on or about October 12, 2023.  NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR  1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, shall either be immediately marked in a manner that readily identifies them as defective, or be tagged with "Do Not Use" or similar language, and shall be withdrawn from service until repaired:  a) 4295 South Route 130, Edgewater Park, NJ - The employer let workers use a portable ladder, Werner FS100 six foot fiberglass step ladder, with defective or faulty components, damaged rails and rung, which were not identified and withdrawn from service as required, thus exposing employee to fall hazards. This condition was observed on or about October 12, 2023.  NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR  1926.1060(a)(1):The employer did not provide a training program for each employee using ladders as necessary, enabling each employee to recognize hazards related to ladders and the procedures to be followed to minimize these hazards:  a) 4295 South Route 130, Edgewater Park, NJ - The employer did not train the employees on the safe usage and hazard recognition of ladders on the construction site in that the employer allowed his workers to use step ladders leaning against a wall and not fully opened and braced in addition to the employees using ladders with damaged rungs and side rails, thus exposing employees to ladder collapse. This condition was observed on or about October 12, 2023.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
