29 CFR  1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:   a) Worksite - On or about October 13, 2023, employees building a concrete form and installing rebar that were working on the northern end of the trench that was approximately 13 feet deep and approximately 45 feet in length had to walk the entire approximately 45 feet in length trench to the southern end of the trench to climb a 10-foot self-supporting A-Frame ladder (Werner) leaned against the side of the excavation to egress the trench.  Employees did not have a safe means of egress.

29 CFR  1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation:  a) Worksite - On or about October 13, 2023, employees building a concrete form and installing rebar while working in a trench that was approximately 13 feet deep and approximately 45 feet in length were exposed to caught-in and struck-by hazards from water accumulating in the trench from the excavation walls without an adequate system to control the water or pump it out.

29 CFR  1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:  a) Worksite - On or about October 13, 2023, employees were exposed to caught-in and struck-by hazards due to working in an approximately 13 feet deep and 45 feet in length trench without cave-in protection in place. There was no competent person at the worksite that could identify and remove the employee from the hazards such as, but not limited to, the excavation wall being approximately 13 feet deep, egress exceeding 25 feet, and water coming out of the soil and stream bed that accumulated water in the trench area.
