29 CFR  1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.   (a)	On and before October 11, 2023, and at times prior, the employer did not ensure daily inspections of an excavation and the adjacent area were made by the competent person for evidence of a situation that could have resulted in a hazardous condition, in that a competent person did not identify the lack of an appropriate protective system or did not take prompt corrective action to eliminate the cave-in hazard.  The excavation was approximately 100 feet in length and in excess of 5 feet in depth.  The excavation was in previously disturbed soil that had sloping in areas that was steeper than 1:1 or 45 degrees, in addition to sections of soil sloughing into the excavation.  This condition exposed employees to a crushing hazard by excavation wall cave-in.

29 CFR  1926.652(b)(2): Maximum allowable slopes, and allowable configurations for sloping and benching systems, were not determined in accordance with the conditions and requirements set forth in Appendices A and B to this subpart:   (a)	On or before October 11, 2023, and at times prior, the employer did not ensure that each employee working in a trench that was in excess of 5 feet in depth was protected from cave-in hazards.  The employer did not comply with the provisions of 29 CFR 1926.652(b)(2), in that the walls of the trench in several areas were sloped at an angle steeper than the maximum allowable angle of one horizontal to one vertical (45 degrees) for type B soil.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a)On or about October 11, 2023, and at times prior, the employer did not ensure that employees accessing the trench that was in excess 5 feet in depth correctly used an extension ladder. The ladder did not extend 3 feet above the landing surface, nor was it secured at the top or bottom to prevent movement. This condition did not provide employees with a safe means of trench egress.
