29 CFR 1926.1053(b)(1): A portable ladder was used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access.  Location: Roof area on side of residence and above 2-car garage:  On or about 10/13/2023, employees were allowed to access the upper landing surface of the residential roof where the side rails of the ladder did not extend at least 3-feet above the surface the employees were gaining access to.

29 CFR 1926.501(b)(13):  Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b).  Location: 30 St Andrews Way, North Chelmsford, MA;  On or about 10/13/2023, employees were allowed to engage in roofing activities without the use of fall protection while working on a residential roof that was 7-feet or greater above the ground below.  United Superior Construction Inc., dba United Superior Construction Corp,  was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1386543, citation number 1, item number 1 and was affirmed as a final order on 09/10/2019, with respect to a workplace located at 1966 Westfield Street, West Springfield, MA.  United Superior Construction Inc. was also previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1634520, citation number 1, item number 1 and was affirmed as a final order on 5/11/2023, with respect to a workplace located at 20 Autumn Leaf Dr, Groton, MA.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.  Location: 30 St Andrews Way, North Chelmsford, MA;  On or about 10/13/2023, the employer has not provided fall protection training for any employee in the company who is potentially exposed to falls from heights greater than 6-feet above a lower level.
