29 CFR  1926.20(b)(2):Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  a)On or about October 16, 2023, the employer failed to conduct frequent and regular inspections of the jobsite. As a result employees were exposed to: 1) Caught-in hazards from an unguarded rotating power transmission pulley on the Predator Engine, 2) Additional caught-in hazards due to an unguarded rotating shaft on a tar kettle, 3) Fall hazards from working at heights over 22 feet without a fall protection system, 4) Risks of falling due to a ladder not extending 3 feet above the roof's landing surface, and 5) Slipping hazards from a ladder covered in tar that had not properly inspected.

29 CFR  1926.300(b)(2): Belts, gears, shafts, pulleys, sprockets, spindles, drums, fly wheels, chains, or other reciprocating, rotating or moving parts of equipment shall be guarded if such parts are exposed to contact by employees or otherwise create a hazard. Guarding shall meet the requirements as set forth in American National Standards Institute, B15.1-1953 (R1958), Safety Code for Mechanical Power-Transmission Apparatus.    a) On or about October 16, 2023, the employer failed to ensure that the rotating power transmission pully on the Predator Engine used by employees operating a tar pump to install a rubber roof on a flat roof was properly guarded, in that the guard was missing. As a result, employees were exposed to caught-in hazards.  b) On or about October 16, 2023, the employer failed to ensure proper guarding on the tar kettle used by employees while operating a tar pump for installing a rubber roof on a flat roof; In that a rotating shaft on the back of the kettle was unguarded as a result employees were exposed to a caught in hazards.

29 CFR  1926.502(a)(2):Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection.   a.) On or about October 16, 2023, the employer failed to install a fall protection system before employee's work installing rubber roofing on a flat roof. As a result employees were exposed to fall hazard of 22'1".

29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.   a.) On October 16, 2023, the employer did not ensure that the ladder being utilized by employees to access the roof extended 3 feet above the upper landing surface as a result employees were exposed to a 22'1" fall from a rooftop.

On or about October 16, 2023, the employer did not maintain ladders free from slipping hazards in that the ladders being utilized by employees to access and install a rubber roof was covered in tar. As a result employees were exposed to fall hazard of 22'1".

29 CFR  1926.1053(b)(15):Ladders shall be inspected by a competent person for visible defects on a periodic basis and after any occurrence that could affect their safe use.  a)On or about October 16, 2023, the employer did not ensure that the Warner portable ladder being utilized by employee to access the roof was properly inspected in that the ladder in use was covered in tar hindering a thorough inspection.
