OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to crushing hazards: Company, Outside Slab Storage: On, or about, October 10, 2023, a Doosan Model G25G forklift rolled forward while an owner and two employees were loading a slab of countertop material on the boom attachment. Although the emergency brake was engaged, the wheels of the forklift were not chocked in accordance with the operation manual and industry standards when parked on an inclined surface.

Capacity, operation, and maintenance instruction plates, tags or decals of the powered industrial truck were not changed accordingly: Company: On, or about, October 17, 2023, an Aardwolf Model FB1-2600 boom attachment was used with the Doosan Model G25G forklift to lift slabs of countertop material. The attachment was not listed on the identification/capacity plate for the forklift.
