29 CFR 1910.120(q)(2): Elements of an emergency response plan. The employer shall develop an emergency response plan for emergencies which shall address, as a minimum, those listed in 1910.120(q)(2)(i)-(xii).  On or about October 7, 2023, the employer did not have an emergency response plan that met all the minimum element requirements listed in 1910.1201910.120(q)(2)(i)-(xii). The employer directed employees to clean up more than one full pallet of Comet with Bleach powder when it was released inside of an enclosed semi-trailer. The employer failed to utilize emergency recognition and did not effectively prevent employees from exposure to chemical hazards during response operations, did not ensure that decontamination methods were provided to employees, did not provide emergency medical treatment or first aid when employees expressed concerns of chest pains and feeling the chemical in their mouth, and did not provide the appropriate PPE for the response.   Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.120(q)(6)(iii): Hazardous materials technician. Hazardous materials technicians are individuals who respond to releases or potential releases for the purpose of stopping the release. They assume a more aggressive role than a first responder at the operations level in that they will approach the point of release in order to plug, patch or otherwise stop the release of a hazardous substance. Hazardous materials technicians shall have received at least 24 hours of training equal to the first responder operations level and in addition have competency in the areas described in 29 CFR 1910.120(q)(6)(iii) (A)-(I).  On or about October 7, 2023, the employer instructed employee(s) to perform the duties of a hazardous materials technician as they responded to a large quantity spill of Comet with Bleach powder inside an enclosed semi-trailer to perform clean-up with a broom. Employees were not provided with at least 24 hours of training equal to first responder operations level and did not have the competency described in 29 CFR 1910.120(q)(6)(iii) (A)-(I).   Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  On or about October 7, 2023, the employer did not provide employees with effective information and training on the chemical hazards associated with Comet with Bleach. Employees were exposed to inhalation respiratory hazards and/or serious eye damage as they were instructed to clean up a large quantity spill of loose powder via a broom and dustpan, in the back of an enclosed semi-trailer with no ventilation. Employees were not provided training on the SDS for Comet with Bleach prior to cleaning up this spill.   Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
