29 CFR  1926.20(b)(1): The employer did not initiate and maintain programs necessary to ensure compliance with the Occupational Safety and Health Standards:        At the jobsite located at 13520 E. Rose Street, Wichita, Kansas, employees were exposed to stuck-by, caught-between, and fall hazards. Employees engaged in framing and groundwork activities were exposed to stuck-by, caught-between, and fall hazards while using pneumatic nail guns, using saw to cut wooden materials, using hammer to nail wood, and working from heights greater than 6 feet above a lower level.  Employees were exposed in that the employer had not initiated, developed and maintained a comprehensive safety and health program with policy, hazard assessment, and work site rules which addressed hazards such as but not limited to fall protection, face/eye protection, head protection and other hazards during framing activities.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  At the jobsite located at 13520 E. Rose Street, Wichita, Kansas, employees were exposed to fall hazards. Employees engaged in framing activities were exposed to fall hazards of approximately 12 feet from the eave of the residence to the ground below in that the ladder used to access the roof was not extended at least 3 feet above the eave and was not secured to the structure.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    At the jobsite located at 13520 E. Employees engaged in residential framing activities were exposed to fall hazards of approximately 12 feet to the ground below in that fall protection was not utilized.  The Victor Hermosillo was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.501(b)(13), which was contained in OSHA inspection number 1611928, citation number 1, item number 1 and was affirmed as a final order on 08/30/2022, with respect to a workplace located at 4807 St. Paul Court Derby, KS 67037.
