29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: (a) On or about October 17, 2023, the employer did not ensure that the employee assisting in roofing operations (ground worker) was protected from potential falling objects from above by the use of a protective helmet. This exposed the employee to a struck-by hazard from a height of 12 feet by material remnants and tools above the working employee.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) On or about October 17, 2023, employees conducting roofing work on an 8:12 pitch roof were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately twelve 12 feet, nine (9) inches on the South side of the roof, and 25 feet on the West side of the roof near the ridge onto grass and concrete when employees were not tied into the available fall protection system.

29 CFR 1926.1053(b)(1): Where a portable ladder(s) was used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. (a) On or about October 17, 2023, the Werner Extension ladder erected on the West side of the structure, at the garage, being used for access to the 8:12 pitched roof, did not extend at least three (3) feet above the landing edge, and/or was not secured to the structure when it was not sufficiently extended. This exposed employees accessing the roof to a fall hazard of approximately 11 feet.
