29 CFR 1903.19(c)(1): The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated.  Site: 401 Beach 35th Street, Far Rockaway, NY 11691.  On or about March 13, 2024, the employer failed to provide abatement certification for citation 1 item 2.  Note: Employer is required to submit certification or documentation of abatement for this violation to comply with CFR 1903.19.

29 CFR  1926.501(b)(13): Each employees engaged in residential construction activities 6 feet (1.8 m) or more above lower level were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 .   Site: 401 Beach 35th Street, Far Rockaway, NY 11691. On or about October 18, 2023, employees working on a residential roof approximately 30-feet above the lower level replacing shingles were not protected from falling to the lower level.  Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR  1926.503(a)(1): Employer did not provide a training program for each employee who were exposed to a fall hazards, and the employer did not have a program to  allow each employee to recognize the hazards of falling and the procedure to be followed in order to minimized these hazards.   Site: 401 Beach 35th Street, Far Rockaway, NY 11691. On or about October 18, 2023,  the employer failed to provide training to each employee that were required to work from a height of approximately 30-feet above the ground level and  were exposed to fall hazard.  Abatement certification is required pursuant to 29 CFR 1903.19.
