29 CFR  1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  A continuing, effective hearing conservation program (including the elements of noise monitoring, employee notification, audiometric testing, hearing protection, training, information, and recordkeeping) was not administered for instances such as, but not limited to:  a)  On or about, October 19, 2023, a dog daycare attendant in the small dog section of the daycare room, was exposed to noise at 76.2% of the permissible daily dose, or an average sound level of 89.1 dBA, as measured over 411 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 88.0 dBA accounting for the period of 69 minutes unmonitored.  b) On or about, October 19, 2023, a dog daycare attendant in the large dog section of the daycare room, was exposed to noise at 90.0% of the permissible daily dose, or an average sound level of 89.6 dBA, as measured over 456 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 89.2 dBA accounting for the period of 24 minutes unmonitored.  Pups Pet Club LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1910.95(c)(1), which was contained in OSHA inspection number 1665355, citation number 1, item number 1 and was affirmed as a final order on June 28, 2023, with respect to a workplace located at 468 New Street, Chicago, Illinois 60611.
