29 CFR 1926.20(b)(2): Accident prevention responsibilities. Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. a) On or about October 18, 2023, the employer did not conduct adequate inspections of the job site. As a result, employees were exposed to fall heights greater than 14 feet in that a complete fall protection system was not being utilized for employees working in the extended basket of a JLG lift.

29 CFR 1926.453(b)(2)(v):A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). a) On October 18, 2023, The employer failed to ensure employees were protected from falling out of an aerial lift during operation through the use of a lanyard connected to the basket via body harness. As a result employees were exposed to a fall hazard greater than 14 ft.

29 CFR 1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. a) On or about October 18, 2023, employees were not trained to recognize fall hazards such as, but not limited to, a fall hazard greater than 14 ft while performing siding work from a JLG Aerial lift nor were they trained on when to utilize a fall protection system.
