29 CFR 1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (a) Production floor: On or about October 18, 2023 and times prior, the employer exposed employees to pulmonary hazards in that the employer failed to provide a medical evaluation to determine employees' ability to wear supplied air and full-face respirators while painting cabinet parts.

29 CFR 1910.134(f)(1):The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT): (a) On or about October 18, 2023, and at times prior, the employer exposed employees to upper respiratory irritation, in that FIT tests were not provided to employees prior to wearing air supplied and full-face respirators.
