29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): (a)Dakota Tube, Inc. at 221 Airport Drive, Watertown, SD 57201: On or about and at times prior to October 18, 2023, the employer did not ensure employees were protected from fall hazards when working on top of bundles of tubing in the vertical tube storage rack at heights greater than four feet above ground level without utilizing an appropriate fall protection system. This condition exposed employees to fall hazards greater than four feet.

This condition exposed employees to fall hazards.
