29 CFR 1910.101(b):"Compressed gases." The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks shall be in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in Sec. 1910.6. The employer was failing to protect employee(s) from struck-by injuries. This was most recently documented on or about October 18, 2023, at 3212 East Hwy 30, Kearney, Nebraska. The employer failed to ensure that a compressed gas cylinder was not stored with other flammable items (aerosol paints and fuel),as described in Section 5.8.2 of the Compressed Gas Pamphlet.

The employer was failing to maintain a list of current chemicals. This was most recently documented on October 18, 2023, at 3212 East Hwy 30, Kearney, Nebraska. The employer had employee(s) utilizing and storing chemicals including but not limited to propane, aerosol paint and butane fuel related to maintenance and repair when a chemical inventory list was not current.
