29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: a) On or about October 19, 2023, as the exposing employer, Sanchez Builders LLC, the exposing employer did not ensure that a daily inspection of the trench was conducted prior to employees working inside the trench. Employees were working in a trench that had 10-foot near-vertical walls, signs of sloughing, and material and equipment at the edge of the trench. This condition exposed employees to struck-by hazards by trench wall cave-in.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: a) On or about October 19, 2023, as the exposing employer, Sanchez Builders LLC, did not ensure that employees were provided a safe means of egress while working the trench that was approximately 10 feet or more in depth. Employees were using a sloped section of the excavation for egress that was not protected, exposing employees to cave-in hazards.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: a) On or about October 19, 2023, as the exposing employer, Sanchez Builders LLC, did not provide employees protection from falling materials or equipment in the trench as the spoil pile was directly on the edge of the trench. Employees were directly below the edge of the trench where the excavator was operating on top of the spoil pile, exposing employees to struck-by hazards.
