29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: a. On or about October 12, 2023, the employer did not ensure one or more methods of machine guarding were provided to protect the operators and other employees from point of operation and rotating part hazards while working on the finning lathe. The rotating pipe/tube was turning while employees held sandpaper against the pipe to remove gouges. b. On or about October 19, 2023, the employer did not ensure one or more methods of machine guarding were provided to protect the operators and other employees from point of operation and rotating part hazards while working on the finning lathe. There was no chuck guard or guarded work zone to contain processed materials, fluids, parts, and tooling within the work zone.

29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation, or the loss of an eye: On or about October 13, 2023, the employer did not report within 24 hours the hospitalization of an employee who received multiple fractures to the left arm while performing work on a finning lathe without proper machine guarding. The injury occurred on October 12, 2023, at approximately 1:00 pm and OSHA was not notified of the hospitalization until on or about October 17, 2023, via the OSHA online injury reporting webpage.
