29 CFR 1926.453(b)(2)(iv):Employee(s) were not standing firmly on the floor of the basket, were sitting or climbing on the edge of the basket, or were using planks, ladders, or other devices for a work position: a) 1117 Kings Hwy. Pilesgrove, NJ: An employee was observed working from a makeshift scaffold attached to an articulating boom lift. The employee was working from the trusses of the roof and then came down to work from the scaffold. The employee was not wearing fall protection and was at a height of approximately 18.8 feet above the ground. Observed on or about 10/20/23. b) 1117 Kings Hwy. Pilesgrove, NJ: A second employee was observed working from a makeshift scaffold attached to an articulating boom lift. The employee was first observed on the right side of the scaffold and then traversed through the basket of the articulating boom lift and then climbed into a scissor lift. The employee was not wearing fall protection and was at a height of approximately 18.8 feet above the ground. Observed on or about 10/20/23. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

Pilesgrove, NJ: An employee was observed working from the edge of a roof without fall protection at approximately 18.8 feet above the ground. The employee moved from the edge and went further up on the trusses and then came down to work from a makeshift scaffold attached to an articulating boom lift. Observed on or about 10/20/23. b) 1117 Kings Hwy. Pilesgrove, NJ: An employee was observed working from a makeshift scaffold without fall protection at approximately 18.8 feet above the ground. The employee then moved to the other side of the scaffold and climbed into a scissor lift. Observed on or about 10/20/23. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
