29 CFR 1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. At a worksite that included buildings located at 4045 Lakewood Way, Lee's Summit, MO 64064 and 4025 Lakewood Way, Lee's Summit, MO 64064, employees were exposed to fall hazards. The employer exposed the employees to these hazards by allowing them to work at heights greater than 6 feet without the use of fall protection or mitigation measures. These hazards were most recently observed on 10/20/2023. Instances of exposure include but are not limited to: Instance 1: Employees were exposed to fall hazards due to the potential for falling off the eastern edge of the roof and to the ground below while working on the building located at 4045 Lakewood Way, Lee's Summit, MO 64064. Instance 2: Employees were exposed to fall hazards due to the potential for falling off the eastern edge of the roof and to the ground below while working on the building located at 4025 Lakewood Way, Lee's Summit, MO 64064.

29 CFR 1926.1053(b)(1):Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: At a worksite that included buildings located at 4045 Lakewood Way, Lee's Summit, MO 64064 and 4025 Lakewood Way, Lee's Summit, MO 64064, employees were exposed to hazards of falling from portable extension ladders. The employer exposed the employees to these hazards by allowing them to use portable extension ladders whose side rails did not extend at least 3 feet above the level to which they were being used to gain access. This hazard was most recently observed on 10/20/2023. Instances of exposure include but are not limited to: Instance 1: Employees using a ladder to access the northeast section of the roof for the building located at 4045 Lakewood Way, Lee's Summit, MO 64064 were exposed to fall hazards as the ladders side rails did not extend more than 3 feet above the level for which they were accessing, nor was the ladder secured to the structure and a grasping handle available for employees to use. Instance 2: Employees using a ladder to access the southeast section of the roof for the building located at 4045 Lakewood Way, Lee's Summit, MO 64064 were exposed to fall hazards as the ladders side rails did not extend more than 3 feet above the level for which it was used to access, nor was the ladder secured to the structure and a grasping handle available for employees to use.
