29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On or about October 19, 2023, and at times prior thereto, the employer did not ensure employees performing roofing work from a three (3) story rooftop were provided fall protection. At least three employees were exposed to a fall hazard of approximately 30 feet to the ground below.

29 CFR 1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. On or about October 19, 2023, and at times prior thereto, the employer did not ensure employees were trained to recognize and use fall protection when required. At least three employees worked from the roof top of a three story new build apartment building without fall protection.
