29 CFR  1926.102(a)(1): The employer had not ensured that each affected employee had used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about October 20, 2023, Giovanni Nixon did not ensure that each affected employee who was exposed to eye hazards from flying particles while operating a pneumatic nail gun had used appropriate eye protection at a worksite at 425 Crystal Trail Drive in Wentzville, Missouri.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels had not been protected by guardrail systems, safety net system, or personal fall arrest system.  On or about October 20, 2023, Giovanni Nixon did not ensure that each employee roofing a single-story residential building at 425 Crystal Trail Drive in Wentzville, Missouri, was protected by guardrail systems or personal fall arrest systems when working 10 feet or higher above the lower level.

29 CFR  1926.503(a)(1): The employer had not provided a training program for each employee who might have been exposed to fall hazards. The program had not enabled each employee to recognize the hazards of falling and had not trained each employee in the procedures to be followed in order to minimize these hazards.  On or about October 20, 2023, and prior thereto, Giovanni Nixon did not provide training to each employee who was exposed to fall hazards. The employees were roofing a residential house located at 425 Crystal Trail Drive in Wentzville, Missouri. Employees were not able to recognize the hazards of falling and were not trained in the procedures to be followed to minimize fall hazards.

29 CFR  1926.59:  The employer had not developed a written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) as incorporated by reference:  29 CFR 1910.1200(e)(1): The employer had not developed, implemented, and maintained at each workplace, a written hazard communication program which at least described how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets (SDSs), and employee information and training would be met.  On or about October 20, 2023, and prior thereto, Giovanni Nixon had not developed, implemented, and maintained at each workplace a written hazard communication program that at least described how the criteria specified in paragraphs (f) for labeling, (g) for maintaining SDSs, and (h) for employee information and training would be met. Gas was utilized in a worksite at 425 Crystal Trail Drive in Wentzville, Missouri, to power air compressors for the use of the pneumatic nail guns.
