OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards. (a) Northeast Sorter deck: On or about 10/16/2023, the employer exposed employees to struck-by hazards in that, the employer allowed the use of the Volvo Loader Model L150H, ID number VCEL150HJ00007188 with an unauthorized attachment which had restricted view between the machine operator and employees on the sorter deck.

29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed: a) At the job site: On or about 10/16/2023 and at times prior to, the employer exposed authorized employees to caught in and amputation hazards in that, the employer failed to conduct periodic inspections as required for equipment such as but not limited to, Bark Loader, CNS, conveyors, Sweep kicker, and Rotary Kicker. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
