29 CFR 1926.1053(b)(1):  Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access:  a)  On October 20, 2023, employees were using an extension ladder which did not extend 3 feet above the upper landing being accessed.   No abatement certification or documentation is required for this item.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):  a)  On or about October 20, 2023, the employer did not initiate a program which provided for frequent and regular inspections of the job site by a competent person.  MJ Construction & Exteriors Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926. 20(b)(2) which was contained in OSHA inspection number 1366103, citation number 1, item number 1, and was affirmed as a final order on March 28, 2019, with respect to a workplace located at 301 Belvidere Rd, Grayslake, IL 60030.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
