29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:   (a) Tanger Outlets Hershey, 46 Outlet Square, Hershey, Pennsylvania - The employer did not have a competent person on the job site in that none of the employees who worked at the site on October 23, 2023 inspected the job site, identified predictable fall hazards, and took immediate actions to correct the hazards.  As a result, employees used aerial lifts without tying off to the lift's basket or boom and employees did steel erection work, including, but not limited to, installing standing seam metal roofing panels, while standing on sloped and flat roof surfaces without using fall protection systems, exposing the employees to the hazard of falling to grade.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and shall state that employees and their representatives were informed of this abatement.

29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employees working from an aerial lift:  (a) At the Front of the Building between Polo Ralph Lauren and Lids Stores - An employee worked from a JLG 400S aerial lift to install standing seam metal roofing panels on the sloped roof above the sidewalk.  The employee wore a harness but did not tie off to the lift's boom or basket, exposing the employee to the hazard of falling to grade, on or about October 23, 2023.  (b) At the Front of the Building between Nike and Calvin Klein Stores - An employee used a JLG 400S aerial lift to access the flat roof of the building.  The employee wore a harness but did not tie off to the lift's boom or basket, exposing the employee to the hazard of falling to grade, on or about October 23, 2023.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and shall state that employees and their representatives were informed of this abatement.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who was on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems:   (a) Building Parallel to Hershey Park Drive, in Front of the Polo Ralph Lauren and Lids Stores - An employee worked from the steel support structure on the sloped roof over the sidewalk to attach standing seam metal roofing panels to the steel support structure.  The employee wore a harness but did not have tie off with a lanyard attached to the dorsal D-ring of the harness and did not use any other fall protection system, exposing the employee to the hazard of falling up to 16 feet 10 inches to grade, on or about October 23, 2023.  (b) Building Parallel to Hershey Park Drive - Employees worked from the building's flat roof to perform steel erection activities, including, but not limited to, feeding standing seam metal roofing panels to other employees attaching the panels to the steel support structure on the sloped roof over the sidewalk in front of the building.  The flat roof did not have a complete guardrail system in that the parapet wall only extended around the front and some areas of the roof's ends while the roof had an unprotected edge along the entire rear side, and the employees did not utilize any other fall protection system, exposing them to the hazard of falling 16 feet 10 inches to grade off the rear side of the roof, on or about October 23, 2023.  (c) Building Occupied by Puma, Perfuroma, Aeropostale, Crocs, Reebok, and Champion Stores - Employees worked from the building's flat roof to perform steel erection activities, including, but not limited to, attaching steel panels to decorative sloped roof structures on the main flat roof.  The flat roof did not have a complete guardrail system in that the parapet wall only extended around the front and some areas of the roof's ends while the roof had an unprotected edge along the entire rear side, and the employees did not utilize any other fall protection system, exposing them to the hazard of falling 16 feet 10 inches to grade off the rear side of the roof, on or about October 23, 2023.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and shall state that employees and their representatives were informed of this abatement.
