The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a) Smitty's Services, LLC located at 16 Lynette Pl N, Westerville, OH 43081:  On or about and at times prior to October 24, 2023, the employer did not ensure employees exposed to falls were provided with a fall protection training program. Employees engaged in gutter installation activities from a residential roof working at heights between nine and 17 feet, were not trained on the recognition of fall hazards and the procedures to be followed to minimize the hazards.

29 CFR  1926.1053(b)(13): The top or top step of a stepladder was used as a step:   a) Smitty's Services, LLC located at 16 Lynette Pl N, Westerville, OH 43081:  On or about and at times prior to October 24, 2023,  the employer did not ensure a step ladder used for access to the roof of a residential garage was properly utilized.  The top step of a nine-foot step ladder was being used for access to a nine foot high roof which exposed employees to falls of nine feet.
