29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  On or about October 05, 2023, during a construction project of a garage for a residential home located at 15900 South Park Blvd, Shaker Heights, OH 44120, the employer did not ensure employee(s) performing framing operations were protected from a fall of approximately 10.6 feet by utilizing a personal fall arrest system or any other form of a fall protection system.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  On or about October 05, 2023, during a construction project of a garage for a residential home located at 15900 South Park Blvd, Shaker Heights, OH 44120, employee(s) performing framing operations were not provided training on how to minimize fall protection hazards, thereby exposing employees to the hazards associated with falls.

29 CFR  1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  On October 05, 2023, the employer did not report the in-patient hospitalization of an employee that suffered a broken clavicle and a fractured skull as a result of a fall from approximately 10.6 feet within 24 hours. The employee was hospitalized for the incident and has not returned to work yet. OSHA was not notified until October 20, 2023.
