29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employees working from an aerial lift: (a) On October 25, 2023, at 620 Mitchell Avenue North in Steele, North Dakota, one employee, and a Project Superintendent were being elevated from ground to roof at heights of over 14 feet in a JLG Aerial Lift 660SJ without using an acceptable fall protection system. (b) On October 25, 2023, at 620 Mitchell Avenue North in Steele, North Dakota, three employees were being lowered from a roof height of over 14 feet to the ground in a JLG Aerial Lift 660SJwithout using an acceptable fall protection system.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system. (a) On October 25, 2023, and times prior at 620 Mitchell Avenue North in Steele, North Dakota, three workers were exposed to fall hazards engaged in the installation of sheet metal roofing on a 4/12 pitch roof of a commercial building at heights over 14 feet without the use of fall protection systems.
