29 CFR  1926.451(a)(6): Scaffolds were not constructed in accordance with the design by a qualified person:   Or in the alternative  OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:   (a) On October 24, 2023, at or near 3800 56th Avenue South, in Fargo, North Dakota, employees were exposed to hazards associated with improperly constructed forklift mounted platform which exceeded the maximum allowable extension past the wheelbase of the forklift.  Note: Among other methods, one feasible and accepted method to correct this hazard would be to ensure that forklift supported scaffold platforms used to elevate personnel conform with the requirements of ANSI B56.6.

29 CFR  1926.416(e)(1): Worn or frayed electrical cords were not removed from service:  (a) On October 24, 2023, at or near 3800 56th Avenue South in Fargo, North Dakota, employees were exposed to electrical hazards were the protective outer coating of a 120 Volt flexible cord set was damaged, exposing the inner wires.  Note:  This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1677067, Citation 2, Item 1, and was affirmed as a final order on August 29, 2023, with respect to a workplace located at 3800 56th Avenue South in Fargo, North Dakota.
