29 CFR  1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:   a. On or about October 23, 2023, the employer had not developed a written hazard communication program for employees performing demolition activities in the guest rooms of the lodge that had the potential exposed to asbestos (carcinogenic).

29 CFR  1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  a. On or about October 23, 2023, the employer had not informed employees performing demolition activities in the guest rooms of the lodge about the presence of asbestos in the yellow drywall joint compound, the health hazards of asbestos, and the measures employees can take to protect themselves from the asbestos.

29 CFR  1926.1101(f)(2)(i): Each employer who has a workplace or work operation covered by this standard shall ensure that a "competent person" conducts an exposure assessment immediately before or at the initiation of the operation to ascertain expected exposures during that operation or workplace. The assessment must be completed in time to comply with requirements which are triggered by exposure data or the lack of a "negative exposure assessment," and to provide information necessary to assure that all control systems planned are appropriate for that operation and will work properly.  a. On or about October 23, 2023, at the jobsite located at 5201 Lodge Road, College Corner, OH 45003, the employer had not conducted an exposure assessment immediately before or at the initiation of the operation to determine employee exposure to asbestos from yellow drywall joint compound during demolition of guest rooms at a lodge.
