29 CFR  1926.1053(b)(1):  Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend to at least 3 feet (.9m) above the upper landing surface to which the ladder was used to gain access nor was the ladder secured at it's top to a rigid support and a grasping device, such as a grabrail, provided to assist the employee in mounting and dismounting the the ladder:  a) On or about October 20, 2023, employees were exposed to a fall hazard of approximately 9-feet 6-inches when they used an aluminum extension ladder that was not extended three feet above the roof landing.

29 CFR  1926.102(a)(1):  Employees did not use eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  a) On or about October 20, 2023, an employee was exposed to struck-by hazards while operating a  nail gun without using eye protection.   Christian Navarette was previously cited for a violation of this occupational safety and health standard 1926.102(a)(1), which was contained in OSHA inspection number 1495486, citation number 1, item number 1, and was affirmed as a final order on November 25, 2020, with respect to a workplace located at 411 Oldham, League City, Texas.

29 CFR  1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:  a) On or about October 20, 2023, employees were exposed to fall hazards of approximately 9-feet 6-inches and greater while working on a roof without tying off.  Christian Navarette was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1495486, citation number 1, item number 2, and was affirmed as a final order on November 25, 2020, with respect to a workplace located at 411 Oldham, League City, Texas.  Cristian Navarette was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1589999, citation number 1, item number 1, and was affirmed as a final order on  June 16, 2022, with respect to a workplace located at 2330 Gentle Breeze Lane, Mont Belvieu, Texas, 77580.
