29 CFR  1926.503(b)(1): (Certification of training.) The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.    a) On or about October 24, 2023 the employer did not have a written certification of fall protection training for all of his employees performing roofing work while not utilizing a fall protection system and exposed to potential fall hazards at heights of above 25 ft. from the ground.

29 CFR  1926.20(b)(2): Accident prevention responsibilities. Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  a) On or about October 24, 2023, the employer does not ensure that a program for the frequent and regular inspections of the job site, material and equipment is being completed by a designated competent person; as a result, five (5) employees are working on top of a church/parish roof not utilizing a fall protection system, exposing them to a fall hazard that is measured greater than 25 ft. from the ground.    The employer Noria Construction, LLC/Ramon Guzman Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.20(b)(2), which was contained in OSHA inspection number 1466418, citation number 1, item number 1 and was affirmed as a final order on July 24, 2020, with respect to a workplace located at 7868 Red Fox Drive, West Chester, OH 45069.

Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toe-boards, safety net systems, or personal fall arrest systems.  a) On or about October 24, 2023 the employer does not ensure that five (5) employees working on top of a church/parish property roof are not exposed to a fall hazard while conducting roofing work.  The employer has not ensured that a complete fall protection system is in place. Employees are exposed to a fall height that is measured above 25 ft. from the ground.    The Noria Construction, LLC/Ramon Guzman Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.501(b)(13), which was contained in OSHA inspection number 1466418, citation number 1, item number 2 and was affirmed as a final order on July 24, 2020, with respect to a workplace located at 7868 Red Fox Drive, West Chester, OH 45069.

29 CFR  1926.503(a)(1):  The following training provisions supplement and clarify the requirements of 1926.21 regarding the hazards addressed in Subpart M of this part. Training program. The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a) On or about October 24, 2023, the employer does not ensure that all employees are being provided training on fall protection systems and on hazards of falls, while working at heights above 25 ft. from the ground.
