29 CFR 1910.1200(e)(1):  The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met, and had not developed or implemented a written hazard communication program which at included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):  a.) TJ&M Services, Inc., 207 South Sumner Street, West York, PA 17404 - On or about October 27, 2023, employees were engaged in cleaning and sanitizing activities for industrial and commercial HVAC systems. The employer's hazard communication program, and associated Secondary Container Label Policy, was deficient in that it lacked information including, but not limited to, the criteria for:   1.) ensuring that each shipped container of hazardous chemicals in the workplace are labeled, tagged, or marked, not defaced, and prominently displayed;  2.) maintaining required safety data sheets for each hazardous chemical, and ensuring that they are readily accessible during each work shift to employees; and    3.) providing employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area.   b.) TJ&M Services, Inc., 207 South Sumner Street, West York, PA 17404 - On or about October 27, 2023, employees were engaged in cleaning and sanitizing activities for industrial and commercial HVAC systems. The employer's hazard communication program, and associated Secondary Container Label Policy, did not include a list of the hazardous chemicals known to be present in the workplace.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
