29 CFR  1910.178(l)(1)(i):The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (a) Building 13 - On or about October 24, 2023, the employer instructed the all-terrain forklift operator(s) to use the lifts to lift personnel up in man basket to work on the face of the buildings without being properly trained.  (b) Building 20 - On or about October 24, 2023, the employer instructed the all-terrain forklift operator(s) to use the lifts to lift personnel up in man basket to work on the face of the buildings without being properly trained.

29 CFR  1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:   (a) Building 13 - On or about October 24, 2023, the employer instructed his employees to work from the man basket with the front guard railing removed, lifted in the air, without the protection of a fall restraint system exposing employee(s) to fall hazards.  (b) Building 20 - On or about October 24, 2023, the employer instructed his employees to work from the man basket with the front guard railing removed, lifted in the air, without the protection of a fall restraint system exposing employee(s) to fall hazards.

29 CFR 1926.453(b)(2)(viii): An aerial lift truck was moved when the boom was elevated in a working position with men in the basket and was not specifically designed for this type of operation in accordance with the provisions of paragraphs (a)(1) and (2) of this section.  (a) Building 13 - On or about October 24, 2023, the employer instructed two employees to enter into the man basket that was full of construction debris, lifted the basket and drove to the trash dumpster, tilted the forks forward to empty the debris into the trash bin, exposing employees to fall hazards.

29 CFR  1926.602(c)(1)(viii)(A):The industrial truck was not equipped with a safety platform/cage firmly secured to the lifting carriage and/or forks when used for lifting personnel:  (a) Building 20 - On or about October 24, 2023, the employer used the All-Terrain forklift with a man basket on the forks to lift an employee up to work on the exterior of the wall without having the man basket//cage firmly secured exposing employee to fall hazards.
