29 CFR 1910.119(d)(3)(ii): The employer did not document that equipment complies with recognized and generally accepted good engineering practices.   On or about October 25, 2023, and times prior thereto in the engine room of Labatt Food Services in Houston, employees were exposed to ammonia chemical release hazards when the employer did not document that it complied with its chosen recognized and generally accepted good engineering practices, such as International Institute of Ammonia Refrigeration (IIAR Bulletin No. 109)section 4.10.1.

29 CFR 1910.119(j)(5): The employer did not correct deficiencies in equipment that were outside acceptable limits (defined by the process safety information on paragraph (d) of this section) before use:  On or about October 25, 2023, in the refrigeration engine room at Labatt Food Service in Houston, Texas, the employer did not replace the broken gauge on an in-service Compressor 4 (C-4-9). This exposed employees to inhalation and chemical hazards of anhydrous ammonia.

29 CFR 1910.119(j)(4)(iii): The frequency of inspections and tests of process equipment shall be consistent with applicable manufacturers' recommendations and good engineering practices, and more frequently if determined to be necessary by prior operating experience:  On or about and times prior to October 25, 2023, in the engine room at Labatt Foods in Houston, TX, employees were exposed to struck-by hazards and chemical hazards of ammonia when the employer did not test or replace pressure safety valves (PSV) on ammonia refrigeration compressors at frequency that is in accordance with the manufacturer's recommendations and good engineering practices including, but not limited to:  a) The Valve HPR1-5 is a Cyrus Shank 813 relief valve installed in 2018  b) Compressor 4: PRV #9 Valve is a Cyrus Shank 813 relief valve installed March 2018  c) Compressor 4: PRV #10 Valve is a Cyrus Shank 813 relief valve installed March 2018  d) Compressor 3: PRV #9 Valve, C3-9 is a Cyrus Shank 812 relief valve installed March 2015  e) Compressor 3: PRV #10 Valve, C3-10 is a Cyrus Shank 812 relief valve installed March 2015 f) Compressor 2 PRV #9 Valve, C2-9 Cyrus Shank 813 relief valve installed March 2015 g) Compressor 2 PRV #10 Valve, C2-10 Cyrus Shank 813 relief valve installed March 2015  h) Compressor 1 PRV #9 Valve, C1-9 Cyrus Shank 813 relief valve installed March 2018  i) Compressor 1 PRV #10 Valve, C1-10 Cyrus Shank 813 relief valve installed March 2018

29 CFR 1910.219(c)(2)(i):All exposed parts of horizontal shafting seven (7) feet or less from floor or working platform, excepting runways used exclusively for oiling, or running adjustments, shall be protected by a stationary casing enclosing shafting completely or by a trough enclosing sides and top or sides and bottom of shafting as location requires.  On or about and at times prior to October 25, 2023, workers were exposed to hazards including struck by, caught in and amputation when the horizontal shafting on the circulating water pump to the condensers, EC-1 and EC-2, were not protected.
