29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):   (a)StoneWood Construction, LLC at 13489 Main Street, Unit B, Rockerville, SD 57702:  On or about and at times prior to October 30, 2023, the employer did not ensure that all forklift operators were competent to operate a powered industrial truck safely by a successful completion of a training program.  This condition exposed employees to struck-by hazards associated with improper forklift operations.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them:  (a)StoneWood Construction, LLC at 13489 Main Street, Unit B, Rockerville, SD 57702:  On or about and at times prior to October 30, 2023, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment; conducted by a competent person.  Employees were exposed to fall hazards while utilizing mobile scaffold systems, unsecured working scaffold platforms elevated by a material handler, and a lack of safety and health training as a result of conducting multi-family residential construction activities. This condition exposed employees to a variety of hazards identified on site.

29 CFR 1926.451(c)(2)(v): The employer did not ensure forklifts to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied:  (a)StoneWood Construction, LLC at 13489 Main Street, Unit B, Rockerville, SD 57702:  On or about and at times prior to October 30, 2023, the employer did not ensure a Haugen Material Handler Personnel Basket, Model Number: MWP 4x116, Serial Number M0021205, was attached and secured to the forks of the Genie Material Handler, Model: GTH-1056 while employees were moved horizontally. This condition exposed employees to fall and ejection hazards while working within the basket and not secure.

This condition exposed employees to hazards associated with improper use of the personnel basket.
