29 CFR 1926.50(b): Provisions were not made prior to commencement of the project for prompt medical attention in case of serious injury: (a) Throughout establishment; On and before October 23, 2023, the employer failed to develop a plan for promptly accessing medical attention before the Winter, WI project was started. On October 23, 2023, an employee received a wrist laceration from roofing metal while trying to stop themself from falling off the roof. The injured worker was driven by a co-worker to get phone service so they could call 911 and meet an ambulance in the town of Ojibwa. Then an ambulance drove the injured worker to a hospital in Ladysmith before a helicopter flew the injured worker to a hospital in Eau Claire, WI for treatment.

29 CFR 1926.50(c): In the absence of an infirmary, clinic, hospital, or physician, that is reasonably accessible in terms of time and distance to the worksite, which is available for the treatment of injured employees, a person who has a valid certificate in first-aid training from the U.S. Bureau of Mines, the American Red Cross, or equivalent training that can be verified by documentary evidence, was not available at the worksite to render first aid: (a) Throughout establishment; On and before October 23, 2023, medical services were not available in near proximity to the worksite and first-aid trained personnel were not available onsite to provide medical treatment. On October 23, 2023, an employee who received a wrist laceration from roofing metal while trying to stop themself from falling off the roof did not have access to prompt medical care.
