29 CFR  1910.178(l)(2)(ii):The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  On or about October 31, 2023, the employer did not ensure one employee operating a powered industrial truck (forklift) had completed formal instruction (written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace in accordance with 29 CFR 1910.178(l)(2)(ii).

29 CFR  1910.178(p)(1):Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating condition(s). On or about October 31, 2023, the employer failed to take a forklift (serial#82824941) out of service, which stalls and is unable to move due to rear wheel contact with surface levels while driving across uneven surfaces.  On or about October 31, 2023, the employer failed to take a forklift (serial#82824941) out of service, which stalls and is unable to move due to load wheel assemblies being worn down that is causing the forklift to lean forward taking the weight off the drive wheel. Second, the caster wheel is so worn that it is taking the weight off the drive wheel and must be replaced. Third, the drive wheel is very worn with the rest of the wheels and there's no weight at the drive unit. The forklift has had no performed services of any type since June 14, 2022.

29 CFR 1910.1030(g)(2)(i): The employer shall train each employee with occupational exposure in accordance with the requirements of this section. Such training must be provided at no cost to the employee and during working hours. The employer shall institute a training program and ensure employee participation in the program.  On or about October 31, 2023, the employer did not ensure that training was provided to an employee with occupational exposure or other potentially infectious materials when assigned medical or first aid duties by their employers in accordance with 29 CFR 1910.1030(g)(2)(i).
