29 CFR  1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a) On or about December 1, 2023, and at times prior, in the production floor, where an operator was exposed to continuous noise at a dose of 88% of the allowable time-weighted average (TWA) during the 11.6-hour sampling period. The equivalent dBA level of 88% is approximately 89 dBA. The action level was adjusted to 82.3 dBA for an extended shift of 11.6 hours.  Zero exposure was assumed for the unsampled time during the shift.  b) On or about December 1, 2023, and at times prior, in the production floor, where an operator was exposed to continuous noise at a dose of 87% of the allowable time-weighted average (TWA) during the 10.3-hour sampling period. The equivalent dBA level of 87% is approximately 89 dBA. The action level was adjusted to 83.1 dBA for an extended shift of 10.3 hours. Zero exposure was assumed for the unsampled time during the shift.
