29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: On October 31, 2023, employees of Mata's Construction, dba: Posadas Francisco Bernabe Mata were performing a re-roof on a residential building located at 322 Regents Park Avenue in Wentzville, Missouri. Employees cleaning up old roofing materials from around the residence did not don protective helmets when exposed to falling objects from above.

Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest systems: On October 31, 2023, employees of Mata's Construction, dba: Posadas Francisco Bernabe Mata were performing a re-roof on a residential building located at 322 Regents Park Avenue in Wentzville, Missouri. The employer did not ensure that fall protection was utilized by employees working on the roof of the building. The employees did not utilize guardrail systems, a safety net system, or a personal fall arrest system, exposing themselves to fall hazards of approximately 14 feet and greater.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: On October 31, 2023, employees of Mata's Construction, dba: Posadas Francisco Bernabe Mata were performing a re-roof on a residential building located at 322 Regents Park Avenue in Wentzville, Missouri. The employer did not provide training on fall hazards and how to minimize those hazards. Employees at the jobsite were wearing Petzel Adjama and Corax LT climbing and mountaineering seat harnesses while working on a 10:12 pitch roof and 14 feet above the lower level. The employees were not able to recognize the hazards with using this equipment in construction. Employees working on the roof were exposed to fall hazards to the ground below.
