29 CFR 1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a.) On October 31, 2023, the employer failed to provide adequate instruction to employees regarding the recognition and avoidance of hazards associated with operating an aerial lift. As a result an employee was exposed to a fall hazard of 19'3" while working outside the basket and not utilizing a body harness attached via lanyard to the aerial lift basket.

29 CFR 1926.453(b)(2)(v):A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). a.) On October 31, 2023, the employer failed to ensure that employees were protected from fall hazards while laying out roofing material from an aerial lift in that the employee was not connected by body harness tethered via lanyard to the aerial lift exposing employees to a 19'3" fall.
